Waste recycling firm fined after worker injured

Sandwell Magistrates’ Court heard how a maintenance engineer was working with a colleague at the Metal & Waste Recycling Limited site in Cradley Heath to replace a seal from a hydraulic cylinder on a scrap metal baling ram.

Whilst attempting to replace the seal, a piece of metal flew off the ram and struck the engineer across the head causing a bleed to the brain and a shattered right cheek and eye socket. On arrival at hospital, the engineer was initially placed in an induced coma to aid his recovery.

A Health and Safety Executive (HSE) investigation found the company had failed to carry out a suitable and sufficient risk assessment of the activity, had failed to devise and implement a safe system of work and had not provided its employees with suitable work equipment.

Metal & Waste Recycling Limited, of Albert Works, Kenninghall Road, Edmonton, London, was fined a total of £20,000, and ordered to pay £2,548.73 in costs after pleading guilty to an offence under Section 2(1) of the Health and Safety at Work etc. Act 1974.
