Farm labourer struck by falling tree

Basingstoke Magistrates’ Court heard how Colin Norgate, a sole trader and designer, making high gloss furniture, had rented a unit at Manor Farm in Petersfield, Hampshire. He was cutting down a tree on farm land which struck farm labourer John Bailey.

John Bailey suffered injuries resulting in the amputation of his left leg above the knee.

An investigation by the Health and Safety Executive (HSE) into the incident found that Colin Norgate failed to set up a danger area and put measures in place to prevent persons from entering the area.

Colin Norgate, of Manor Farm, Langrish, Petersfield, Hampshire, pleaded guilty to breaching Section 3(2) of the Health and Safety at Work etc Act 1974, and Regulation 9(1) of the Provision & Use of Work Equipment Regulations 1998, and was fined £830 and ordered to pay costs of £2,349.
